Iran: 4th Campaign for Hasanpoor & Butimar

The Kurdish activist Mr. Hiwa Butimar is still in jail. While the Tehran Supreme Court on September 4, 2008 overturned the death sentence against the journalist Adnan Hassanpour. His case is sent back to the revolutionary tribunal in the city of Sanandaj. 

DI is deeply concerned for the well-being of Mr. Butimar who currently awaits execution and Mr. Hassanpur who is facing serious charges that may even result in 20 years imprisonment.

Abdel Wahd (Hiwa) Butimar

  • Human Rights activist Mr. Abdel Wahd (Hiwa) Butimar is detained in Mariwan (or Marivan) city in west of Kurdish Province. He is now allowed to meet his family twice a week.
  • Unfortunatly he is still facing  death penalty sentence for speaking for tolerance and democracy.

Adnan Hassanpour

  • On September 4, 2008, the Tehran Supreme Court overturned the death sentence pronounced against the journalist Adnan Hassanpour, because the judgment could not consider him as an “an enemy of God”. His case is sent back to the revolutionary tribunal in the city of Sanandaj.
  • Mr. Hassanpour is currently in custody at a detention centre in Sanandaj (or Sine), the capital of Kurdistan Province. He is allowed to meet his family once a week.
  • DI is still concerned about Mr. Hassanpour’s retrial on charges of “working for outlawed parties” and “espionage”. He is facing serious charges that may even result in 20 years imprisonment.

The case:

On September 4, 2008, the Tehran Supreme Court overturned the death sentence pronounced against the journalist Adnan Hassanpour on July 9, 2007, because the judgment could not consider Mr. Hassanpour as a “moraheb” (an enemy of God). His case is sent back to the revolutionary tribunal in the city of Sanandaj. While the Kurdish activist Mr. Abdel Wahd (also known as Hiwa) Butimar is still in jail waiting to be executed.

DI Views & International law:

  • DI is deeply concerned about Mr. Butimar and Mr. Hassanpour’s retrial on charges of “working for outlawed parties” and “espionage”. Mr. Hassanpour is facing serious charges that may even result in 20 years imprisonment. This is happening at the same time as Mr. Butimar has again been sentenced to death on charge of “enmity against God” (moharebe).

 

  • International law

The ICCPR states:

Article 6.1: E Every human being has the inherent right to life. This right shall be protected by law. No one shall be arbitrarily deprived of his life.

Article 6.2: In countries which have not abolished the death penalty, sentence of death may be imposed only for the most serious crimes in accordance with the law in force at the time of the commission of the crime and not contrary to the provisions of the present Covenant and to the Convention on the Prevention and Punishment of the Crime of Genocide…

This can obviously in no way encompass the peaceful expression of dissent.
