The case:
Defend International has been informed by the International Secretariat of MCT about the acts of torture suffered by Mr. Nur Hasan Khan, alias Kallu by several police officials while in detention on 11 September 2007 at the Narkeldanga Police Station, West Bengal, India.
“According to the information received, Mr. Nur Hasan Khan (about 20 years old) was arbitrarily arrested on 11 September 2007 reportedly to get information on his brother-in-law Javed whom the police believed to be involved in a robbery. Mr. Nur Hasan Khan was detained at the Narkeldanga police station where he was tortured by the administration of electric shocks.
Mr. Nur Hasan Khan was reportedly released on bail granted by the court (ACJM Sealdah) on 15 September 2007. He has reportedly to face trial under the charges of theft.”
DI Demands:
Defend International raises same concerns as OMCT over the torture suffered by Mr. Nur Hasan Khan. The NGOs are also concerned with accountability and want to put an end to impunity for human rights crimes and the fear instilled in the victims to denounce these practices and abuses.
Although India has signed onto the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, it has failed as yet to ratify it.
Moreover the Indian Government is in violation of the International Covenant on Civil and Political Rights (ICCPR), to which it is party.
The ICCPR states:
Article 7: No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment
Article 9.1: Everyone has the right to liberty and security of person. No one shall be subjected to arbitrary arrest or detention.
OMCT and DI Call on the government of Indian and the relevant authorities to:
- Conduct a thorough and impartial inquiry, at the earliest opportunity, into the allegations of torture in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law; and
- Ensure that individuals are properly protected in the state of West Bengal.
In addition, as an elected member of the United Nations Human Rights Council, India should particularly guarantee full respect for human rights and the fundamental freedoms throughout the country in accordance with national laws and applicable international obligations and commitments.
